ASSAULT. John Farrell was charged on the information of Ah Chang with mailicious assault. Mr Barton appeared on behalf of complainant. The assault complained of took place on the arrival in Hawera of a conveyance in which accused and complainant were passengers , from the races. Evidence was given as to the nature of the assault. When the trap stopped, and while still in the conveyance, accused knocked complainant's hat off, and then struck him in the eya. No provocation had been offered. Accused used violent and abusive language. T. Coffey, driver, gave corroborative evidence, adding that Ah Chang was threatening another Chinaman previously. John Farrell, the accused, said that when coming from the races those in the express seemed to be wrangling with Ah Chang, who turned round to strike accused, who then struck him in the face. He believed, he was pushed on to him, but having lost his temper he had struck him. He was sorry it had happened, and had offered to apologise. His Worship said the evidence proved that an assault hud been committed, but as defendant had offered to make amends he would impose the minimum penalty. Convicted and fined l0s and costs.
